Judge Orders Gay Officer Reinstated


The U.S. military violated the constitutional rights of decorated Air Force Reserve flight nurse, Maj. Margaret Witt, when it discharged her under the "don't ask, don't tell" ban on gays in the armed forces, a federal judge said Friday, September 24, 2010 in ordering her reinstatement.

The judge did the wrong thing for the right reasons. Of course, gays should have a right to serve their nation in war and in peace as they have (in secret) throughout the history of the US. However, judicial activism is an end-run around the legislative and executive bodies of our government that is being used too frequently. Undermining the delicate balance of our republic during the present economic chaos and in war time is an unacceptable risk. Unfortunately, I think the greater good will only be achieved when the electorate of this country uses their constitutional power to force their legislators to right the current discriminatory policies against gays in the military.
